WindEurope answer to the public consultation on the guidelines for the Foreign Subsidies Regulation

WindEurope provided feedback to the public consultation on the Foreign Subsidy Regulation (FSR) guidelines. The FSR is a crucial tool aimed at addressing the distortive effects of foreign subsidies on the EU market.

The response outlines several key recommendations and considerations for the European Commission to ensure that it effectively addresses the challenges posed by unfair foreign subsidies and protects the competitiveness of the EU market, particularly in the wind energy sector. Among other, WindEurope proposes certain additional targeted criteria to the open list of indicators in Article 4(1) to determine the existence of a distortion. We also take the opportunity to highlights two main practical issues related to the implementation of the FSR provisions, namely 1) the misalignment on the pre-notification thresholds, and 2) the disproportionate administrative burden for third countries which are deeply integrated with the EU market.
